clients herby agrees that he/she will be fully responsible for any
upload files appearing under clients account including content ,
images , media files , etc.. . we do not accept any excuse regarding
such as ( claiming account hacked , sever hacked ,lost password ,
etc.. )
Pornography and sex-related sites and such a merchandising is prohibited on all hosting
plans of hostingbangkok.com include sites that include sexual hard-core
images. incase of any clients site appears to be under the violation
of using policy we not only suspend such an account but also we will
not release any refund and the issue will be reporting to state
Authorities for investigation.
Any illegal activity, which may causes, harm or damage to the
hostingbangkok servers or any other servers, is prohibited. There are
some examples as mention below.
Pirated software
Hacker programs or archives
Warez sites
Any site that consumer more than 20
Insecure mail form ( No image Verification )
Multiple Mysql connection for sending php mail or any other script
is not allow
on our server due to server over loading
Traffic usage policy:
Each hosting plans has its own amount of traffic or bandwidth, we
monitor all
Accounts and bill 420 Baht for each gig of traffic exceeded.
Please notice that 1MB-1GIG will be billed the same.
Free Domain Name Registration Policy:
A) Client is required to read and agree with all terms and condition of

Including (ICANN) Domain Name Dispute Policy and comply with above

B) With regards to our 30 days money back guarantee policy, and a free
domain registration, in order to avoid many individuals who may utilize
our free services, there are some terms and condition which have been
designed to help us to spend time to built servers and providing
support for legitimate clients only, so please note that client

Uptime Policy:
We strive to maintain a 99.9% network and server uptime service level,
this uptime percentage is a yearly figure and does not include any
scheduled /hardware /software upgrades, nor act of God. Our definition
of "act of God" includes; fire, flood, tornado, earth quake, Telco
fiber issues or Backbone peering point issues, as well as network
floods, hacks, and attacks, if Hosting Bangkok fails to meets its,
99.9% uptime guarantee, and it is not due to one of the above reasons,
partial down time credit will be made available to each clients, upon
request, on a case by cases.

Unlimited Bandwidth Policy ( Share Hosting ) :
There are currently six hosting plans
(B100,B1000,B2000,B4000) which have been provided for the
clients who needs to have a large amount of bandwidth, however , we do
not charge clients for additional bandwidth with these plans, but it is
not recommended to use more than 50 GB bandwidth which have been
allocated for these plan (B4000) . And 35 GB which have been allocated
for plans (B1000,B2000) And 25 GB which have been allocated for plans
(B100 ), so it is important for clients to know that using
more than these amounts of traffic may cause slowing down the server
and as a result it will use more than 20% of the network resources
which is effect the reliability of our server that is what if it
appears that client is using more than the amount of bandwidth that it
has mentioned above, He/She will be asking to resolve the matter
immediately.
ISP & iSP DNS Cach Policy :
Account Verification
We require to verify any account on server this is base of security
policy of our network with this regard Client herby agrees to
provide Hosting Bangkok with a copy of their passport or ID ( Thai
Only ) the verification process will require at the time of account
setup
Client agrees that Hosting Bangkok will not be in charge for any error
message or failing to deliver clients e-mail using outlook express since
such an application is required to build a bridge connection between
server and clients isp ( Internet Service Provider ) ! with this regard
the server is not accountable as the only source for delivering clients
e-mail.
Spamming ! sending of unsolicited e-mail, from a
hostingbangkok.com server or using an e-mail address or domain that is
maintained on a hostingbangkok.com servers, as reference is prohibited,
we will impose 6,000 Baht penalty for Spam policy violation.
Chat Rooms , MP 3 , Media Applications ( Share
Hosting ) :
We do not allow clients to install their own chat rooms , mp3 nor any
media application on share hosting packages As it causes to be a
large drain on our system resources and it
cause slowing down our servers.
Background running programs:
Background daemons in general are prohibited. these are considering on
a case-by-case basis if allowed an extra charge will be incurred base
on system resources used and system maintenance needed.

Server Policy for Windows 2003
All folders under windows 2003 server share clients have been installed as on default base on Microsoft supported .Clients herby notice we do not change any files or folder permission for security reason nor install any clients software under share server environments .
Dedicated Server Policy
Please Note : 30 days money back policy does not apply to dedicated
Server
contract however!
All dedicated server clients should comply with The Law of State of
Thailand
as well as terms and condition of data center any violation with
this regard will not only result of account termination but also we
will contact the Law Enforcement Authorities .
Server security
:
Asia It Com will not be responsible for any content material under
clients account , we provide client with user name & password and
make sure client has 24/hours access to server however ! this is the
full responsibility of each client to save such a sensitive material
as well as use the secure software and connection to make sure there
will be no such an issue ( site hack ) appearing on server. all
dedicated server is unmanaged with this regard site security is clients responsibility not our network .
client may hire server administrator party or server security expert
to make sure they will not have such a problem security problems in
future.
Please notice that we do not allow telnet nor ssh on our Network for
security reason clients will have 24/hours access only through ftp .
IRC
We currently do not allow IRC OR IRC bots to be operated on our server.
Refusal Of Service
We reserve the right to refuse, cancel, or suspend services at our sole
discretion.
Billing
Account Reactivation !
Any delay on billing cycle may result the account
suspension and there will be additional 1000 Baht charges in order to
reactive such an account .
Renew Billing:
We have no refund policy for clients who will renew their contract . refund policy will be apply only to new clients who signup within 30 days of their account setup time . also setup fee is not refundable
Reseller Cancellation Refunds:
Reseller cancellation refund is valid for 15 days starting from the
date of placing an order by client ! All refund will be credit back to
client account at the end of month . however ! the setup is not
refundable for reseller nor for virtual client .
Virtual Hosting Cancellation Refunds:
After 30 days clients may still cancel their accounts but cancellation
will become
at the end of their current contract period and no partial refund will
be given.
Please note: Domain Name Registration fees will not be refunded.
Account Support Assistant :
Client herby acknowledge that we do not reply to any support issues
through e-mail for security reason we kindly request all clients to
open a ticket for support through our ticket system on our website
under help section client also agrees to not open a duplicated ticket
and understood that any duplicated ticket will be not only help on time
responding issue but also it will remove from Hosting Bangkok
( ticket system )!
We assist the clients with all support for services provided thru
Hosting Bangkok, we will help you with basic setting for your email
software and ftp clients, as well as assist you to use the web browser
control panel, but we can not teach each client, how to use the another
companies product, for example, we may assist you with the setting for
using MS FrontPage, but we can not teach the client, how to use the
product itself, you need to contact the software maker with this
regard, who provide technical support for how to use their product on
the market. We cannot even attempt to support All the thousands
software product in the market also ! We do not create any database nor
delete them from server , script programming ,uploading , downloading
files for clients under the virtual Hosting contract unless stated base
on additional contract ( other services )those are the responsibility
of clients .any customization of database tables delete or create files
or databases will cause additional charges and it is not included to
any virtual Hosting Plans.
Limitation of liability:
Hostingbangkok.com shall not be responsible for any claimed damages,
including incidental and Consequential damages, which may arise from
hostingbangkok.com going off-line or being unavailable for any reason
whatsoever, furthermore, hostingbangkok.com shall not be responsible
for any claim damages, including incidental or consequential damages,
resulting from the corruption or deletion of any web site from one of
hostingbangkok.com Servers. All damages shall be limited to the
immediate termination of service.
Disclaimer:
Hostingbangkok.com cannot be held liable for system downtime, crashes,
or data loss.
We cannot be liable for any predicted estimate of profits in which a
client would have
Gained if the site was functioning. Certain services provided by
hostingbangkok.com are resold. Thus certain equipment, routing,
software, and programming used by hosting Bangkok are not directly
owned or written by hostingbangkok.com. Moreover we hold no
responsibility for the use of the accounts. If any terms or conditions
are failed to be followed, the account in question will be
automatically deactivated. We reserve the right to remove any account
without advanced notice for any reason without restitution as hosting
Bangkok sees fit. FURTHERMORE, We retain the right to change any or all
of the above policy without notification.
1. Up to date information; use of information and expiration
You agree to notify hostingbangkok.com within five (5) business days
when any of the information You provided as part of the application
and/or registration process changes. It is Your responsibility to keep
this information in a current and accurate status. Failure by You, for
whatever reason, to provide Asia it Com Network with accurate and
reliable information on an initial and continual basis, shall be
considered to be a material breach of this agreement. Failure by You,
for whatever reason, to respond within five (5) business days to any
inquiries made by Asia it Com Network Co.Ltd. to determine the
validity of information provided by You, shall also be considered to
be a material breach of this agreement. You agree to retain a copy for
Your record of the receipt for purchase of Your domain name.
2.You agree that for each domain name registered by You the following
information will be made publicly available in the Whois directory as
determined by ICANN Policy and may be sold in bulk as set forth in the
ICANN agreement:
• The domain name
• Your name and postal address
• The Internet protocol numbers for the primary and secondary name
servers
• The corresponding names of the name servers
• The original date of registration and expiration date
3.You agree that, to the extent permitted by ICANN, Asia it Com Network
may make use of the publicly available information You provided during
the registration process. If You engage in the reselling of domain
names You agree to provide any individuals whose personal information
You've obtained, information about the possible uses of their personal
information pursuant to ICANN policy. You also agree to obtain
consent, and evidence of consent, from those individuals for such use
of the personal information they provide.
4. suspension of services; breach of agreement
You agree that, in addition to other events set forth in this
agreement, Your ability to use any of the services provided by Asia it
Com Network is subject to cancellation or suspension in the event
there is an unresolved breach of this agreement and/or suspension or
cancellation is required by any policy now in effect or adopted later
by ICANN.
You agree that Your failure to comply completely with the terms and
conditions of this agreement and any Asia It Com Network rule or
policy may be considered by Asia it Com Network Co.,Ltd to be a
material breach of this agreement and that Asia it Com Network may
provide You with notice of such breach either in writing or
electronically (i.e. email). In the event You do not provide Asia it
Com Network Co.,Ltd with material evidence that You have not breached
Your obligations to Asia it Com within ten (10) business days, Asia it
Com Network Co.,Ltd may terminate its relationship with You and take
any remedial action available to Asia it Com Network under the
applicable laws. Such remedial action may be implemented without
notice to You and may include, but is not limited to, canceling the
registration of any of Your domain names and discontinuing any
services provided by Asia it Com Network Co.,Ltd to You. No fees will
be refunded to You should Your agreement be cancelled or services be
discontinued because of a breach.
